Deferred Enforced Departure (DED)

Through Executive Orders from President Biden, Deferred Enforced Departure (DED) has been approved for certain countries, which will allow nationals from these countries to remain and work in the United States. DED is the president’s discretion to authorize as part of his constitutional power to conduct foreign relations. 

Although DED is not a specific immigration status, individuals covered by DED are not subject to removal from the United States for a designated period of time, as listed below.

In order to qualify for work authorization under DED (Category Code A11), you must meet the following requirements:

• Must be a national of one of the approved countries
• Must have been physically present in the US on the effective date listed in the chart above
• Must have continuously resided in the US since the effective date listed in the chart above

*Please note, you ARE eligible to apply for Advanced Parole (AP), which will allow you to travel outside the US, however, please note if you travel back to your home country, your DED can be terminated.

Reasons DED may not be approved:

• If you have voluntarily returned to your home country
• You have not met one of the above 3 criteria
• You have been convicted of a felony, or two or more misdemeanors committed in the US
• If you are subject to extradition
• If the Secretary of Homeland Security has deemed your presence in the US to be a danger to public safety.
• If the Secretary of State has reasonable grounds to believe your presence in the US would have serious adverse foreign policy consequences for the US.
